Texas Daycare Sued After 3-Year-Old Comes Home Injured — Staff Allegedly Deleted Surveillance Video

A Texas family is suing a Frisco daycare after their 3-year-old son repeatedly came home with unexplained injuries — including a hole in his lip where his teeth had gone through.

What Did Parents Discover?

Parents Alexus Benavidez and Rauf Scott say they began noticing unexplained injuries on their son but were told by staff that everything was normal. According to a lawsuit filed May 1 by The Button Law Firm in Collin County Court, 15 separate surveillance videos captured caregivers using excessive physical force on multiple children in the facility’s 3-year-old classroom.

What’s on the Videos?

Footage from June 5, 2024 allegedly shows caregivers:

  • Yanking the boy by his arms
  • Spanking and striking him
  • Forcefully shoving him into a chair, causing bleeding
  • Ignoring his cries while he limped to get his own paper towel

The Cover-Up Allegation

According to the lawsuit, Kids ‘R’ Kids management became aware of the abuse weeks before notifying parents — after another parent reported witnessing aggressive behavior and immediately withdrew their own child.

Instead of reporting the incidents to Texas Child Protective Services, the facility’s owner allegedly deleted the camera footage and instructed a staff member to delete her saved copy as well.

That staff member reportedly refused and reported the daycare herself, triggering a state investigation.

What Did Investigators Find?

The Texas Department of Family and Protective Services concluded that the force observed in the footage posed a substantial risk of serious physical harm to children. Investigators confirmed the daycare had received prior reports of rough handling and had even issued internal warnings to employees — but never notified parents or authorities.

What the Owner Said

The facility’s owner called the situation “very painful” and said the caregivers involved were hired by previous ownership and immediately terminated. He said he was “unaware” of the allegation that footage was deleted.

What the Mother Said

“I was horrified to learn that my 3-year-old son was harmed by the people we trusted to keep him safe, and they lied to me,” mother Alexus Benavidez said. “We are filing this lawsuit to get answers.”

Texas law requires daycare facilities to report suspected child abuse to authorities. The lawsuit alleges Kids ‘R’ Kids violated that mandatory reporting requirement in an effort to “preserve appearances and avoid getting into trouble.”
